Terms of Service

1. Acceptance of Terms

By accessing or using dubtrivia at dubtrivia.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and dubtrivia ("we," "us," or "our"), operated from Ontario, Canada.

2. Description of Service

dubtrivia is a free daily trivia game. Each day, a new set of trivia questions is published. Users can play once per day, track their scores and streaks, and connect with friends. The Service is provided free of charge.

3. Account Registration

You may play dubtrivia as a guest without creating an account. To access features such as streak tracking, statistics, and friend connections, you must create an account using either an email address and password or Google OAuth sign-in.

When creating an account, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us promptly of any unauthorized use of your account
• Accept responsibility for all activity that occurs under your account

Users under the age of 16 must have the consent of a parent or legal guardian to create an account and use the Service.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service, other accounts, or systems
• Use automated scripts, bots, or other tools to interact with the Service
• Circumvent or attempt to circumvent play-once-per-day restrictions or other game rules
• Create multiple accounts to gain an unfair advantage
• Interfere with or disrupt the Service or servers connected to the Service
• Harass, abuse, or harm other users
• Share answers to the daily trivia set before the day has ended in a manner intended to undermine the game
• Use the Service in any way that could damage, disable, or impair the Service

5. Usernames

When you choose a username, you agree not to select a username that is offensive, misleading, or infringes on the rights of others. We reserve the right to reclaim or change usernames at our sole discretion, including usernames that are inactive, violate these Terms, or infringe on trademarks.

6. Intellectual Property

All content on dubtrivia, including but not limited to trivia questions, explanations, graphics, logos, design elements, and software, is the property of dubtrivia or its licensors and is protected by Canadian and international copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service or its content, nor may you reverse-engineer or attempt to extract the source code of the Service, unless applicable law permits it or you have our written permission.

7. User Content

The Service may allow you to set a username and profile information. You retain ownership of any content you provide but grant us a non-exclusive, worldwide, royalty-free licence to use, display, and distribute that content in connection with operating the Service.

8. Availability and Modifications

We strive to keep dubtrivia available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.

9. Termination

We may suspend or terminate your account and access to the Service at our sole discretion, without prior notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

You may delete your account at any time. Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination will survive, including but not limited to intellectual property provisions, disclaimers, and limitations of liability.

10. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, secure, or uninterrupted, or that any content is accurate or reliable.

11. Limitation of Liability

To the maximum extent permitted by applicable law, dubtrivia and its operators, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use of or inability to use the Service
• Any unauthorized access to or use of your account
• Any interruption or cessation of the Service
• Any bugs, viruses, or other harmful code transmitted through the Service

In no event shall our total liability to you for all claims arising from or related to the Service exceed one hundred Canadian dollars (CAD $100.00).

12. Indemnification

You agree to indemnify, defend, and hold harmless dubtrivia and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another person or entity.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts of the Province of Ontario, and you consent to the personal jurisdiction and venue of such courts.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and dubtrivia regarding the use of the Service and supersede any prior agreements.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
